These Terms of Service ("Terms") govern your use of emberstone-capital.com (the "Site"), operated by Emberstone Capital, LLC ("Emberstone Capital," "we," "us," or "our"). By using the Site, you agree to these Terms.
1. Informational Purposes Only
Content on this Site is provided for general information. It is not financial, legal, tax, or investment advice, and it is not an offer of insurance. Insurance products are offered only through licensed professionals, are subject to underwriting, and vary by state. Product guarantees are backed solely by the claims-paying ability of the issuing insurance company. Insurance products are not FDIC insured.
2. No Client Relationship
Submitting a form or booking a session does not create a client, advisory, or insurance relationship. A relationship exists only when a policy is issued by a carrier or a separate written agreement is signed.
3. Text Messaging (SMS) Program Terms
Program description: Emberstone Capital, LLC offers two optional text messaging programs to people who provide express written consent through unchecked checkboxes on our website forms: (a) a marketing program with insurance product information, appointment scheduling, and financial strategy updates, and (b) a non-marketing program with appointment confirmations, reminders, and service updates.
Message frequency: Message frequency varies based on your interactions with us.
Cost: Message and data rates may apply according to your mobile carrier plan. Emberstone Capital does not charge for text messages.
Opt out (STOP): Reply STOP to any message at any time to cancel. After you send STOP, we will send one final message confirming your opt-out, and you will receive no further messages from that program.
Help (HELP): Reply HELP to any message for assistance, or email patrick@emberstone-capital.com.
Consent is optional: Consent to receive text messages is not a condition of any purchase or service. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.
Carriers: Supported carriers are not liable for delayed or undelivered messages.
4. Acceptable Use
You agree not to misuse the Site, including submitting false information, attempting to interfere with the Site's operation, or using the Site for any unlawful purpose.
5. Intellectual Property
All content on the Site, including text, logos, and design, is owned by Emberstone Capital, LLC or its licensors and may not be copied or reused without written permission.
6. Third-Party Links
The Site may link to third-party websites. We are not responsible for their content or privacy practices.
7. Team Applications
Team pre-applications are subject to the disclosures on our Join the Team page, including independent contractor status, commission-only compensation, and geographic restrictions. Submitting a pre-application does not guarantee acceptance.
8. Disclaimer of Warranties and Limitation of Liability
The Site is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Emberstone Capital, LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the Site.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
